The words of Horace reflect the concerns about party walls as areas of development become tighter and the boundaries between adjoining owners increasingly need consideration to avoid frustration.
However, despite its title the Party Wall Act is not solely concerned with party wall, it regulates the relationship between neighbouring owners which might not always involve a party wall. The Act, for example, regulates excavations, at particular depths within certain distances, even where no party wall is present.
The role of the Party Wall surveyor can therefore be simplified as the requirement to mitigate unnecessary inconvenience and balance the interest of respective owners. On one side is the Building Owner who wishes to exercise their right to build on their land and on the other the definition of the work that maybe lawfully carried out and subsequent monitoring to ensure compliance for the Adjoining Owner.
The role is not to settle boundary disputes between neighbours or to stop building taking place
